    Dropped off paperwork should be happy but...

    I feel annoyed....

    I give this attorney a retainer back in august. I got all the paperwork together and fill out their online form. I go to drop the paper work off and I only see the receptionist. I had the paper work in a nice expandable folder(Advice off here) and they made me take it out and put it all once in stack. Then she was like oh we really don't need your credit card statements.....I was like well i was asked for them and went though the trouble of printing them out so she decided to take all the paperwork.

    I didn't see the attorney or anything. Told her I had questions and she went and asked the paralegal i guess but i didn't even see the paralegal. The receptionist then came back with my answers. She said it should take about 10 days to get the paper work together..... I feel like I might be at a bankrutpy mill..I don't care if they get me the discharge...I can't afford to have them mess this up.


    When is the attorney suppose to ask me if i want to keep my house and what cars i want to keep?

    They haven't asked me anything yet. I want to see if they are going to get me in the chapter 7 or if they are going to push me for a 13 to try and get money. I know i pass the means test.

    Ugh....just had to vent.

    Attorneys seem to be really busy at the moment. Does you attorney specialize in bankruptcies and charge the appropriate fee? Or is this a high volume BK attorney?

      I dropped off our paperwork to our BK Attorney on Sept. 2nd to the Paralegal. I too, had copies of the CC statements & stapled to them was any Collection Agency letters we received.

      Hubby finally called last Fri. & paralegal (New!) said she doesn't work on the papers until a week before our scheduled appt. & Attorney was booked. Even though I had lost my voice, I took the phone from hubby & explained to her we started this process last Sept. & BK Attorney knew we wanted to file on 9/30/09. She says we still owe $300 Wrong! As she was talking, I pulled up my bank account & gave her the date check cleared our bank. She knew I was irated.

      About 2 hrs. later, the phone rings & it's the Paralegal saying we are to be at the Attorney's office this Thurs. at 9:30 am and it will last about 2 hours. Not a good time for Dh as he is an OTR Truck Driver. However, his company agreed to give him the time off for the appointment.

      I think every day, more people are scheduling Free Consultations with a BK Attorney and end up filing BK. Thus, the Attorney is Really Busy.

      If you don't hear anything by the 10th day, I would certainly call your Attorney and ask what's going on? Good Luck!

        I submitted the final payment to my attorney during a scheduled appointment today. The majority of my paperwork had been completed. I brought my completed version of Schedule J and personal property. My attorney went through the paperwork with me and asked if I intended to surrender/reaffirm the house and car. I signed countless documents, his office is going to revise my paperwork to note my secured intentions/Schedule J/personal property, and I'll return to sign and file. The majority of my debt information was obtained through a credit report (my attorney didn't require every credit card statement).

        My guess is that some of the items you dutifully organized will be required to complete your paperwork. Have you paid your attorney in full? If not, this may be a factor as well. I am surprised you don't have any indication if you're a C7 or C13 candidate. Perhaps they are assessing this now? (My attorney proclaimed C7; although, I remained fearful until he laid out all the numbers this afternoon).

        Regarding questions...can you contact your attorney/paralegal via email? This method often gives them the opportunity to respond during non-business hours.

        Let's hope the ten days is needed for careful assessment and preparation! Hang in there!

          Yes he does a lot of bk plus like medical malpractice and he charges 1400$ which im ok with the fee if they do it right. This is why im paying.

            I ran the numbers before myself and I look like a 7 so they put me down for a 7. At least I know they will ask me back to ask me what property i want to keep and what i want to giveup. I have not paid attorney in full. They said I can pay them in full on the bk signing day. we will have to see what happens.
