Medical was discharged - got collection letter

I had to be taken to the hospital via ambulance April 2007 and needless to say the 15min trip cost $1128.00. I included this account in my CH7 BK and as you see, was discharged.
Yesterday I got a letter from the medica center saying they are going to take my state tax refund to satisfy the bill. Can they do this? Should I contact my BK attorney?

If the debt was included in your BK and discharged then NO they cannot collect on it by any means.

I've also never heard of a medical provider being able to do a tax intercept like that. I think they are blowing smoke. If I were you I would send them a copy of your discharge papers showing that your debt to them was wiped out with your BK. What ever you do DO NOT PAY IT!

Unless they have already sued you for payment and gotten a judgment against you, this is all a bluff.

Take a copy of your discharge order and a copy of their notice and send it back to them with a short note letting them know that they are breaking the law and that you will be contacting your attorney.

Send everything certified with a return receipt, so that you will get the green card back with someone's signature. Keep copies of everything in your file. Most likely you won't hear anything back.

Following up, I had a "slight misfortune" with a skill saw across my abdomen, a couple years ago. I did a "drop cut" many times in my life, but this one bit me.

Ambulance charge? $19,000.00 and some change. Yes it was a life flight, and as a private pilot, I entirely enjoyed the trip. Whatever was in that drip I was on I could have used in a 341. LOL. 'Hub
