    My husband and I just filed chapter 7 and we received this motion in mail today from a car loan company that we are having them take the car back. What does this motion mean (motion for relief from stay and abandonment of personal property) and how will it affect us?

    The 'Motion for Relief from Stay' is a court procedure that the car lender must make in order to take back the vehicle. They are not allowed to contact you at all by law until after you are discharged. This is a formality that lets them be able to pick the car up. There should not be any trouble for you.

    I am not sure what the 'Abandonment of Personal Property' is in this context, unless it is an acknowledgment that you are surrendering the vehicle, and therefore that statement is in the title of the motion.
