    341 Report

    Hi All,

    Today was my very much dreaded 341 hearing. I barely slept, but managed a few hours. When I arrived, I sat in the room waiting for my attorney. He did call me and tell me he was running a bit late. "Great!" I thought. That would give me time to watch others. I watched about 20 cases waiting. Most were all the same thing.

    There sat a frail old man, with a cane and braces on both his arms. He wore glasses that were the thickest I have ever seen, and he was attempting to read his paperwork while holding it less than a inch from his nose. He was dressed in rags, but probably the best he had from what I could see. When his attorney arrived I could overhear part of their conversation. This man clearly had lived a rough life, but also had a obvious mental slowness about him. In any case, I felt bad for this man having to go through this. When his turn was call to the Trustee, the man raised his right hand to be sworn in and was visably shaking. I suspect the stress had gotten the better of him this morning. Thankfully the Trustee was very kind and brief with him. But as he left I was reminded of how lucky most of us have it. We may be broke financially, but clearly this man had many other challanges that life had handed to him. He left a impression on me, and I couldnt help but think to myself how very lucky I have been.

    T: I have the drivers license and social security card for the person before me, and the pictured ID shows to be the person before me.
    T: Did you read the documents before you signed your petition?
    me: Yes
    T: Was the information contained in this petition correct and accurate on the date of filing?
    Me: Yes
    T: Have there been any changes?
    Me: No
    T: Where do you work?
    Me: ***************
    T: Where is that located?
    Me? ***************
    T: How did you come to the value of your home?
    Me: Based on what others around me are selling for.
    T: You are free to go.
    Me: Thank you sir, have a nice day.
    T: (smiled as nobody said this all morning) Thank You, you do the same

    That was IT!! While I was answering his questions he wrote a couple things down. I seen him write "NO ASSET" on one document, and he then added my name to a long list of names. I have to assume the list was for those he was finished with. (I pray I am right with this).

    Anyhow, I think I am officially in the 60 day club. I also think that what I seen the Trustee write means I will have a positive report when he files his comments.

    Anyhow, count our blessings. No matter how rough we think things are for us, there is always someone much worse off.

    Thank you also for sharing the story of the older gentleman. It is a valuable object lesson.
