    Why you should check PACER after your 341 meeting...

    From NOLO, How to File for Chapter 7 Bankruptcy, 12th Ed., page 4/10: Check www.pacer.uscourts.gov and read your docket entries!
    I'm in N. California ... Thanks for your replies!
    10/11/05: bought www.form7.com software
    10/14/05: Filed Ch 7 BK Petition pro se skeleton
    10/27/05: Filed all schedules, etc.
    11/17/05: 341 meeting (done!)
    01/16/06: Last day to file objections
    01/18/06: Discharged, closed

    It is a good idea to periodically check the status of your case. You don't want any surprises, Pacer will be updated before you get a letter. You won't always get a letter either. Our vehicle lender requested to be updated via mail, guess they didn't want to check Pacer. We never got notice of that.
    I'll be watching, you may never know when or how, but I'll be there. I am there now....

      Our 341 was October 31,2005

      OK question I have printed out the "Docket Information and Related Docket entries" it says that the meeting was held, and "objections for Discharge due by 12/30/2005."
      Also under the "Deadlines/Hearings" it is listed as 12/30/05.

      However the trustee didn't make his entry till November 2nd, stating it was No asset


      So what date will it be?? 12/30/05...or 01/02/06 ? I know there is not much difference between the two, but 1 day seems like forever around here!!...LOL

        12/30 vs 01/02

        Check your calander 12/30/05 is a friday 01/02/06 is monday. Maybe it has to do with a holiday date New Years? You will be fine as we all are.

          I thought the creditors had 60 days for objections. Are you saying that they only have 30?

              objections to the exemptions listed need to be filed within 30 days from 341 meeting.

              objections to the dischargability of the debt need to be filed within 60 days from the 341 meeting.

                      We filed BK on 06/13/05, 341 on 07/20, last day to object 09/20. I checked pacer just now like you said and on 08/05 it says "Approved by order of the U.S. BK Ct. The said estate(s) is hereby CLOSED. Does this mean we're discharged as well? Is this the document I need to keep for filing to show in the future in case some creditors come back to collect? We filed a motion to determine dischargeability of a student loan on 09/20. We are waiting for a respond from the plaintiff. I know the case isn't closed because of the pending adversary proceeding, but the BK portion could still be discharged, right? Thanks for your help.

                        I have seen differences in PACER between the date "entered" -vs.- date "recorded" or "filed". the date entered is probably NOT the important date... Often, there is a lag of a day or three, especially with Friday - Monday... I think the important date is the date FILED.

                          Filed Bk on 06/13/05, 341 on 07/20, last day to object 09/20. I checked pacer like you indicated and found this: on 08/05 in re: to report of trustee in Ch. 7, No asset case - Approved by order of the US BK CT. The said estate(s) is hereby closed. Does this mean we're discharged, too? I didn't get a letter from the mail, but I guess this is good enough. Thanks for your help.

                            In PACER, each district may use slightly different procedures...

                            The TRUSTEE's report is NOT the discharge! It just means that the trustee is satisfied that you have no assets...

                            Do you see line entries like:
                            ... Order Discharging Debtor and Final Decree...
                            ... Bankruptcy Case Closed...

                            Just to the left, there are numbers, they are underlined if there is a document attached... like 6

                            When you right-click on the number, IF there is a PDF file, you can download and save it. Then open it and print it. That is the document you need to have. Hope this helps!

                              Nothing. It says Pending Statuses when I looked at the "STATUS". I don't understand why it's taking a while. I did see case file may be unavailable . . . I think because we have a current adversary proceeding, but that has nothing to do with the BK though. That's a separate issue. Last day of objection was 09/20. Hmm. Thanks again for your help.
