    How to pay for lawyer

    My in-laws gave us some money for part of the retainer and I always just go to their bank and cash it and then take the cash to my bank so there are no problems. The lawyer said it does not matter how I pay but should I just pay cash so I do not have another large deposit going into my account?

    Also when I pay the balance to file should I get a cashiers check from the bank so they money comes right out and I do not need to wait for the lawyer to cash it since that will leave my account at a very high balance(it is being direct deposited so I rather not carry that much in cash on me).

    I would do US Post Office money orders. Do not use money orders from any other source. The money won't go into your bank and you have a trackable/guaranteed payment method.

      It would actually be better if they paid your lawyer directly. Once you touch that money in any form, it is yours and you must declare it income or an asset. Silly yes, but the way it is. If it is a gift, let them pay direct. If it is a loan, then you also are violating the bk rules. That is, if you have filed, but the look back is six months at this point. Longer if there are income or asset questions. Be safe. 'Hub

        I paid my retainer fee with 1000 $1 bills that I was saving up for other things...
        But a stupid lawsuit made me file bankruptcy...

          It was a gift but my MIL will not pay the lawyer because she does not want my FIL to know we are filing because he is judgemental. So I have $400 cash right now and I am adding $100 to it so what should I do?

          I thought that if it was a gift for things like bills it was not an income? Our families have been helping us out with trying to get caught up but always give us a check. I am soooo confused the receptionist told me that they have to list that and my student loan refunds but they are not considered income.

            lol...that reminds me of the commercials from staples were people want to pay for expensive art and stuff with pennies and the seller does not want to take it...lol. Did you have to prove were the money came from at the 341?

                Pay the lawyer $500 in cash and get a receipt from them. Tell your lawyer where the funds came from and he will give you the best advice.

                  That is what I did....paid in cash and they would just give me receipts each time.

                    i also paid in cash... It took 3 trips to his office but we got it done...thankfully! Got a receipt that is with my bankruptcy information...
                    chpt 13 11/25/08 converted 7/7/09 to a 7. No assests and surrendered vehicles...
                    9/2009 Scores 515-565 & working up from here...10/9 they havent budged yet....why does our puppy & bk lawyer have the same name...lol Discharged 10/28/09 now the real work begins

                      You stated you go to their bank and cash their check as I've underlined above right? Well then, do the same with this check & just take the cash along with other cash to pay for your Attorney. Just make darn sure you get a receipt from the Attorney's office as they (including their personnel) are only human and mistakes could be made.

                      PS You want your checking account to be as low $$$ ON THE DAY of filing. So you will need to find out what day your Attorney plans on filing your BK. I know, because our Attorney files all of his cases on the last day of the month.

                        I have to pay $1500 next month should I take that out of my account as cash or get a cashiers check?
