    When will our BK be discharged?

    Hi, everyone . . .

    We filed BK on 06/13, then 341 meeting on 07/20, and last day of objection was on 09/20. We filed our adversary proceeding on 09/20 regarding our student loan, so that is pending. I checked pacer yesterday and clicked on the "status" tab and it didn't say anything. All it said is Pending althought on August 5th the trustee filed a no asset case. Does that mean we're discharged? I actually want to see the word discharged, but don't know where to find it

    My other question is when we filed the adversary proceeding, the defendant had until 10/26 to respond to it. When I checked pacer it didn't indicate whether they responded or not, but we do have a hearing scheduled on 12/30/05. Does that mean the defendant did reply and it just doesn't show on pacer? So sorry, but am so confused. Thanks in advance for the help.

    Why are you doing adversary proceedings on the student loan. Those normally are not discharged. You may have to wait 60 days after the meeting. When was your 341?
    You also need to remeber that the system is very backed up at this point and may take awhile for Pacer to be updated. What has your attorney said?
    I'll be watching, you may never know when or how, but I'll be there. I am there now....

      You meant to write that you "responded" to the "adversary proceeding" filed by your creditor, yes? Please explain more about your interesting case...

        We filed a motion to determine the dischargeability of student loan because we received a reaffirmation agreement from the loan bank in Auguest after we filed BK last June 13. 341 was on July 20. The loan is not insured, guaranteed or funded by any non-profit or governmental agencies. I actually had this long discussion with HHM and according to HHM (and according to our lawyer) we have a good chance of our student loan being discharged. The school is also private (a flight academy). Thanks so much for your input. I appreciate it.

          Hi,

          No, we filed the adversary proceeding and we're waiting for the loan bank to respond to us. We checked pacer and I've noticed that we have a scheduled hearing on 12/30 on this matter. I wish the bank would just say whether the student loan is dischargeable or not (but that would be way too easy for us). Like I said to Sunshine08 because the loan was not insured, guaranteed or funded by any governmental unit, the student loan doesn't fall into the non-dischargeable category. We're hoping and praying that it would be. If you want to know more just click on my name and it'll show all the conversations I had with HHM. All I asked HHM was about the student loan. Thanks for the link, but I don't think it pertains to us.
