    just made final payment to Lawyer.. question

    Hello everyone,

    So I met with my lawyer back in August and I just sent him the final payment so I can file. I took my credit counseling class today as well. My question is my bank (credit union) sent me a letter saying they are starting collection actions and reposession. How long will it take my lawyer to file the stay ( i think this is what you call it) so the bank can not garnish my checks or take my car? I feel like I am in a race with the bank. At this point if I tell the bank I have filed will they stop everything or do they have to hear from the lawyer?

    You really need to ask your lawyer this questions, because I have seen where some lawyers take a few weeks to process the paperwork and file. So just because you have paid him/her, and even IF you have all your paperwork turned in...your case may not be ready to file yet.

    Only your lawyer can give you a idea on WHEN they will actually file the papers. Once the papers are filed, I believe the stay is in effect and it generally only takes a few days for the banks to be notified.

    Also, as others on this forum have recommended be sure you move your bank accounts to a bank NOT directly related to your filing. Credit Unions have a reputation for being a bit tough to work with.

      I spoke with my lawyer today. He said we will file the papers sometime next week so I guess we will get this ball rolling.. I hope this all works out and all the stress will be gone.. so glad to be starting over.. Ive really learned a hard lesson about credit cards..
