    Repossession...

    When we converted our Chapt 13 to a 7 we gave up both of our vehicles that we were backwards in... The place that our Truck was at came to pick up the truck within 2 weeks, and the place where the car was financed through still hasnt came for it for it (we filed for the 7 on July 6th).. I am afraid the car getting a tow sticker...lol But wondering when they will get this car.. the lender has 4 initials....(dont think I can list them here)... but what is the typical timeline for them to come get a volunteer repo? Should I call them or my lawyer??

    if your talking about hsbc, it took them 18 months to come and get my truck.

      Oh my goodness gracias!! Yes I am talking about them.. thats ridiculouly a long long time.. I would be driving it now but the battery died...lol Maybe I will jump it and see if we can get it going again...

        It's definitely NOT GMAC...lol they filed a relief of stay and picked that puppy up from me right away.

        I owed 18 k on it and now it's for sale for 13k at a dealership nearby. I was weirdly pleased when I saw the ad "NEAT AS A PIN INSIDE"

          lol Nope its not... The car has a bad battery.. so i wont be driving it around...lol But will see if we can jump it (after dh gets rid of the spider web that huge...lol

            I was wondering the same thing about reposession. we also are converting from a 13 to 7 and I just sent a request to my attorney asking if we could bring it to a dealership? has anyone ever heard of that happening? do you think that is possible? thx

              It's possible. That's what we did. We surrendered a car with a loan through GMAC. They never sent us anything in the mail, called, or repo'd the car. Automatic stay prevents any of those. They did send my lawyer a letter requesting the address where the car is kept and for permission to contact us. Lawyer chuckled and tossed it aside. GMAC never filed a motion to lift the stay. The day we got our discharge papers in the mail, GMAC called wanting their car back. They allowed us to take it to the nearest GM dealership for drop off, which we did. They even gave us a few days to get that done.

                I filed on 6/10, 341 was 7/17 and haven't paid on my Toyota since May 1st payment. Going on almost 5 unpaid months. The loan is with Wachovia.

                  Update..

                  I called the lawyers asst. and she said to call them.. So I made a phone call after 3 times entering my information... I got a live person.. She says they sent a letter to my lawyer at the end on July and they needed the letter back from my lawyer with his signature on it... HSBC also did a follow up call on the 16th of August... So I got another call in for the lawyer.. I mean my gosh... come get it already...
