    First post, excited nervous and sick

    I'm sure you've all heard it before. Were just in over our heads. I'm sick about it but have reached the breaking point.
    We have never been late on anything.. but my kids don't go to the dentist often (nor do we.. ever) and I need new tires, and my dogs need the vet.. all things sacrificed so we can pay our cc's and loan.

    We never expected for hubby to lose 2 jobs within 3 years (construction) and although we are glad he's got a good job now, we can NOT catch up.

    So 2 quick questions...

    1. We've never been late.. does that make a difference?

    2. I've done cash advances months ago at a casino. Will I be brought over the ringer?

    I know, not smart. Lesson learned the hard way. Some people retail shop when there depressed, I hit the slots.

    Just want to know what I'm walking into.

    Welcome and good luck on your journey. I'm sure you'll find great insight and support here.

    Gambling is a common issue with BK...just search the topics here. Should not be an issue. No one ever asked why we filed BK, atty, trustee, no one. They don't really care why and I don't even think it's a relevant legal question.

    Most attorneys will tell you that if you are sure you are filing, stop paying your credit cards immediately. I was like you and this was really hard to do, but I'm glad I did. This is how you save for your attorney fees and start an emergency savings account, because your credit will be gone. Every card you have will be closed. Now is the time to go to the dentist, buy new tires and stock up on food!!! And create a budget that will work in the long term with your spouse.

    If you're not sure you're going to file, keep paying and meet with several attorneys. But if there's something that has to go unpaid, it should be the credit cards. It will be around six months before they will even begin the lawsuit proceedure...you have plenty of time.

        I felt like such a loser (and I am NOT putting anyone down here..) for thinking about filing when I knew some of it was due to gambling. Were talking 1 card here, about $2000 total. Very small beans considering our whole issue is about $70,000 in debt.

        I have been reading, and I feel a little better knowing it is our "RIGHT" to be able to file, and not a favor being done to us.

        We are a hardworking family, with 4 jobs between us.. and just can't seem to get swimming.

        My husband is creeping on 40, and we can eithor do it now, or keep putting money into bad debt.. and have nothing to show for it.

        I actually wish we could file tomorrow, but they are sending us the paperwork, and things that need to be gathered, and we meet next Tuesday with our attorney!

          Just remember, all will be well. I would highly recommend meeting with several different attorneys and finding one that you feel most comfortable with. Get your documents together, but usually there is no rush to file. Time is on your side. All the credit card people can do is call you and send you nasty letters that mean nothing. Don't let that intimidate you. Do it on your terms.

            A couple of reminders. If you owe any money where you bank, change to a new bank immediately and stop all auto deposits to and payments from your account. Don't use any of your credit cards.

              It can and will happen to a lot of people. I'm sure that none of us thought we would be here, but we are. You're not a loser unless you turn yourself into one, and that's not what you're doing. You're doing the things required to make it better for you and your family. Nothing about that is being a loser.

                An old member here racked up a LOT of gambling debts and had a lot of worries, but came through fine. He also posted very detailed accounts of his experiences and decisions, so you may wish to search for his username:
