    Mortgage Question

    I will ask this question once more and hope someone will be able to reply. When you file a chapter 7 do all late fees have to be paid in full to be considered current on your mortgage? I have approx. $1070.00 in late fees and need to be current when I file for chapter 7 (keeping house). Please if you know the answer could you reply? Thanks

    06-2010:341 Meeting (went very well)
    08-24-2010: Discharged; 09-02-2010 Closed!!

    No expert, but I would think Yes! Current is current...and that includes paying any late fee's owed (I would think).

      It wouldn't hurt to tell them you are filing ch7 and ask for a waiver of the late fees.
      Filed Ch7 5/28/09 (Pro Se) Orlando, 341 7/01, UST selected case for audit 7/01, Last day for objection 8/31. Audit report filed 9/10, no material misstatements. Discharged and closed 9/22/2009

        Hmmm.... I never thought about telling them that. I was denied a home loan modification based on all of my debt. How weird... I need the loan mod but now I have to wait until filing to do that. Would notifying the mortgage company that I plan to file in a few months be a good idea?
