    Chapter 7 Fee Waiver

    Hey, Everybody. I just left the Central District BK Court in Riverside, Cali, attempted to file my Chapter 7 Petition, but was told I had to return on Mon. when the Judge would rule on my Waiver app.

    I am totally indigent, no income whatsoever. I have been surviving on whatever family and friends can assist me with. I filed my own case 'cause I can't afford an attorney or even one of the 'so-called' free services. I worked on the needed forms since 8-11, with the help of the Nolo book, and seem to have done all right so far, since the clerk said I submitted everything I needed to.

    This question is for ANYONE who has ever been granted a WAIVER. BTW, the receptionist, the clerk and the supervising clerk all reminded me that waivers are very seldom granted. I kinda felt like they were trying to discourage me from filing a waiver. However, from what I have read on this forum, most people who file seem to be able to afford to pay the filing fee, as they have jobs, are collecting unemployment or have some kind of income. I have zero income at this time. Back to the question. If ANYONE has been granted a waiver, can you tell me what the criteria was that you met to prompt the judge to grant you a waiver, i.e., did you have income, however slight?

    One more question. If my home is about $245,000 under water, is there any need for me to use the homestead exemption on Schedule C and to state on the Schedule of Intent that I am claiming my home as exempt? Any response to my questions will be greatly appreciated. DGranny
