Credit card apps and false statements

    Only one year in my district and it is not filed, it is provided to the trustee only unless the creditor requests something. Also, it is not provided in your schedules. The only thing that the creditors can access on pacer here is your schedules and your last 60 days of paystubs before your file, which could have changed, as my DH's did -- hence the reason for BK.

    It is unfortunate that there are things that vary from district to district or that because a trustee has only 10 cases all day you get railed for things that other trustees don't pay attention to, but we have all to deal with that in every district. About 10 years ago in Cali. the courts decided to make all court forms "standard" - judicial council forms and procedure was supposed to be the same. Each court still uses some of their own forms, and each department and Judge has their own rules.

      Thank you everyone. My wife and I just left the lawyer. He didn't seem to be concerned with my employer being a creditor. My employment with this bank has been stellar. He wasn't concerned about the false credit card applications either. The accounts are over 6 months old and we have not made any luxury purchases...we have never been late and are current on each cc account.

        Did you overstate your income on the application for the card you have at your bank? That could be an issue if they decide to look further.

          A coworker submitted the application using our internal application. I don't know what income amount he submitted. I am considering paying this cc if we file bk. i can't "mess" where i eat.

            Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick
