    Status change: VCIS (vs. PACER)

    I'm too cheap and way to OCD to sign up for Pacer. I'm scared of running up $$$ and feeding into my frenzy. So I've been calling VCIS occasionally.

    We had our 341 yesterday and I called this morning. Now it says:

    AWAITING DISCHARGE!!!!

    Sweet! Anybody know if this also means the TT is not filing a presumption of abuse and he's done and all that crap?

      Probably a good sign but the UST has 10 days (someone correct me if I am wrong) from the conclusion of your 341 to file a statement of abuse. That is what happened in our case anyway.

      I use Pacer all the time, several times a day, and am not charged a dime because I sign in and look at the date of last filing. If the date has not changed since the last time I checked nothing new has been filed. You are only charged if you view a document. In case you are interested.

        Kingxray: Did you know about the UST before your 341 or were you totally surprised by their filing?

            I just want to say that this is not true!!!! I learned the hard way (was charged $30) that if you run a query that has more than 1 result (ie, anything that isn't a unique identifier to one case) you will be charged just for running that query!

            So if you are not just looking up your case using a unique identifier (your case number or you are the only one with your last name in the query database) you WILL be charged just for searching, even if you don't look at a single document.

              Yep, VCIS is free. It's old school but it works. I'm pretty confident we're good to go. Got absolutely no interest from the TT whatsoever, just standard ?'s. Didn't want any more infomation, documents, nothing.

                  Huh. I have not been charged for running a query. That's odd.

                    Not surprised at all. We filed in Oct. and UST got involved so we dismissed our case, changed our B22 and schedules and refiled (at the advice of the UST). When we were at our 341 (which was continued) my dad's lawyer showed up again (we weren't surprised), he in turn went to the UST to stir up trouble (cuz he can't win an AP) and then the UST filed the statement of abuse. No motion to dismiss yet but our lawyer plans to fight it if there is one filed. I hoping the UST is just buying time because they have not asked for anything more from us, but maybe that is just wishful thinking. So to answer your question, the UST was not involved until after our 341 when my dad's lawyer contacted them, but we were expecting that.

                      One has to wonder about a relative (let alone a parent) that would set out to make your life intentionally miserable.

                      Hopefully you'll make it through this. I think 99% of the people know about the UST's involvement either pre-341 or at their 341, if I'm not mistaken. Someone correct me if I'm wrong.

                        Yeah my dad is a crumb. I am an only child and my mother is dead, so it really sucks and he has really ruined our lives. Thank god I have my husband and my children.

                        It is possible our lawyer knew about the UST before the 341, as they are the ones who suggested to him to refile. He may have concealed it from me becasue he is aware that I am stressed beyond my limits. He does talk to the UST about our case and they are aware that it is my father, so we'll see.

                          I'm sure you will. If you've been upfront and have documentation to support, you will be okay.

                          In the end, your dad will have succeeded in making it more of a hassle for you but you will still come out ahead and be able to look at yourself in the mirror, can he say that. . . .

                            How true, thanks! We weren't trying to rip him off, he just wouldn't wait for our house to sell to pay him what we owed. He is the one who put us in this BK situation by trying to garnish my husband's wages. He thinks he's the good guy getting ripped off and we are the bad guys. Who would have thunk it?
