The presumption of abuse is totally separate. That is an action brought by the BK TT or the UST, trying to push you into a 13 or dismiss your case.

Objections are completely separate and don't even affect your discharge date. Check out HHM's sticky on AP's....it's very informative.

I have never been involved with anyone having a manic phase of bipolar, but they I was convinced that all my time spent working for the money was finally paying back because we were going to get somewhere with two incomes. You have no idea what a manic phase of bipolar can do to your world. I have asked the attorney to advise whether we can win or settle, obviously going the less expensive method. But if I have to repay, I will have to borrow the money. Great!
I understand what you are going through. We have been dealing with my brother-in-law's mental illness for 10 years now. It started as bipolar (and yes that manic stage is unblievable) and now he is diagnosed with schizoaffective disorder. What a nightmare, the hospitalizations, the psychosis, homelessness, etc. Hang in there and make sure your spouse takes her meds everyday. That is the hardest part of this illness.

If your spouse has been hospitalized then you do have documentation of the bipolar condition, use it! And as others have said, it wouldn't hurt to have your lawyer contact State Farm and explain the situation. Good luck. I know what you're going through.
