    Fired off the "File" E-mail.

    So after somedays of going back and forth on a couple things on my BK papers I fired off the E-mail tonight for my attorney to file. It's been really pleasant so far. I'm just waiting for his confirmation to let me know it's done so I have a case # if a creditor calls. They haven't really been calling too much. (Surprisingly) Although I'm only over 30 days on like 4 cards and a loan. Either way it's seeming more "Official". I just want it to be over. I look at it as, it took me 4 years to UNFORTUNATELY get myself in this situation and it'll take me some time to get out. (Hopefully 60 days. LOL) Anyways just dropping a letter to keep you all posted and anyone considering it needs to keep the positive in mind. Credit heals with time. A late payment is going to stay on your credit file for as long as the BK will and since I had NEVER missed a payment I decided I need to file because I could not get ahead and my life is more valuable than making payments every month and only having rates increase on me because of the "economy" and banks saying I couldn't have a loan to consolidate because I have too much debt. Catch-22 much? It was only getting worse. Keep your head up and please make sure you learn from this situation. I surely know I have. Talk to you all soon!

    I have not filed yet but my attorney said that we could start giving his number to them if they called. I was getting 10-15 calls a day from Chase, sure I have 4 accounts with them). Last night I gave them his number and all is quiet again. I called them, after looking up my account(s) he started running down how much in late, over limit etc.... I interrupted and told him that I was calling to give him my attorney's information. He asked for name, number and chapter. I gave him t he info and he thanked me. Ahh, that didn't hurt a bit.

      Good for you guys. It does get better.

      I know your credit probably recovers a bit quicker if you don't miss many payments leading up to BK, but my theory is if you're going to BK, might as well let it go....most atty's seem to say that as well.

      It was really hard to stop paying bills and deal with the phone/letters as I've ALWAYS been extremely responsible and on top of everything. But remember, the banks DON'T GIVE A CRAP ABOUT YOU. In retrospect, I may have stopped paying everything for six months, saved up as much $$ as I could, then filed. Your credit is shot for two years anyway....

      Anyway, good luck on your journey...better days ahead....!

        I gave out the attorney phone number but a coupled creditors keep calling. One is BOA, and the other is NCO. NCO is located in India and they don't seem to understand English.

          If you want them to stop calling, tell them flat out to contact your attorney and they ARE NOT to call you anymore. If they persist, send a cease and desist letter and start taking notes, because they're violating the Fair Debt Collections Act once you tell them to stop contacting you and you can sue them.....($1000 per violation).

          Most reputable firms will stop at this point. I had to file a complaint with the FTC on Capital One, who were persistent. THEN they suddenly stopped and I even got a letter from one of their bigwigs apologizing if you can believe it.

          Just realize that once you're filing, you're in the driver's seat and you can screw back with them a little bit. It's kind of nice.

          I got a collections letter from US Bank several weeks after I filed (they were fully aware/notified). I called them and they FREAKED OUT. I'm pretty sure just realizing the deep (*&$ they were potentially in. They asked me to throw the letter in the garbage. HA!!!

          Regardless, hang in there. If you think about it, isn't it great that all they can do is call you?
