We were just discharged under Ch 7. Prior to filing I notified my lawyer that 2 creditors (who were solely my own, not my husbands), had filed liens on OUR house. He said they could be removed because it was not legal to put liens for one person on a jointly owned property. I thought that I paid extra to have them removed.
I see today they are still listed on the Maryland state website as "entered".
I emailed the lawyer a week ago asking if they removed them yet. I get a response back today saying there was nothing to remove because a lien could not be put on "jointly-owned property" (but the legal word for it- I can't get it to come up on the www). Left the email at work, so I will have to post it tomorrow. Found it! "tenancy by the entireties"
Even though I was very clear about these liens existing, neither were put on the Ch7 - should they have been?
We were trying to keep the house, but got discharged without being reaffirmed. If we get a refi later, can these liens affect the sale of the home?
