    Was my vehicle discharged? Deficiency balance?

    This feels like a stupid question, but we have received no communication from our lawyer since we found out on Pacer we were discharged and closed almost 2 weeks ago. You would think they would send us something to say- congrats! If we didn't have Pacer we still wouldn't know!

    Our original intention was to keep the truck. When I filled out the papers with the lawyer, that was the box we checked.

    Then we had a change of heart, and decided to stop making payments and let it go in the Ch7. It was listed with our house under "secured debt". The full payoff amount was listed.

    Is it true that everything/one that is listed on the BK is then discharged, unless reaffirmed?

    My DH is worried when he turns in the truck in a week that they will come after him for a deficiency balance.
    4/27/09- 6 judgements, 2 liens, 3 bank levys later ... 2nd lawyer visit. 5/4/09- Paperwork done. 5/14/09 signed, filed Ch7. 6/23/09 - 341 meeting DONE!
    8/25/09 - Discharged! 8/27/09- Closed!!!

    A statement of intention is just that-an intention.

    Unless, you signed a reaffirmation agreement , the debt is discharged and you have no liability for a deficiency balance.
