I filed an emergency petition pro se on Oct 4th and was given Oct 31 as my 341 meeting date. They also gave me 15 days to get the rest of my schedules in. An emergeny petition is just the petition and the statement of social security numbers. Anyway I got the schedules in on Oct 18th one day before the sue date. Yet there was still another form that I didn't turn in. The clerk gave me the form and I wasn't going to be able to make it back to the courthouse before the due date. Nevertheless, I mailed it overnight and saw that it was delivered along with an installment payment.
Ok, everything is fine, right? WRONG I stay up all night doing some work for my job and putting the finishing touches on my amended schedules. Yeah, no sleep at all. My kids wake up too sick to go to school. So they have to go with us. We get there and there is a line way out the door. When we finally get inside we are told that our case is continued and that there is a motion to dismiss. I scrounge around trying to find out what the deal is. Come to find out that all my schedules had not been turned in. The clerk goes to the back to check. She comes back with my date stamped schedules that had never been put in the system. Mind you when I went in that day at 4:30pm there was no one else in the office. The clerk's excuse?
"We had 2000 petitions that's what happened." Never once did she apologize. So now I have to call around and try to get it straightened out with the trustee. AND I NOW HAVE TO WAIT UNTIL NOV. 28 for another 341 meeting. WHAT A DRAG. I would have been discharged before 1/1/06, but not now.
To top it all off. I go back to work to pick up my paycheck, which I needed like a week ago, and it's in the safe. The boss is a meeting and I can't wait because I have to go to my part-time job.
It was just a bad day all around. The sad part is if we make a mistake in paying a bill to the government or to a creditor we have to pay, but if they make a mistake WE STILL HAVE TO PAY. Something is terribly wrong with that.
