    Filed, spending cash, now what?

    We will be filed on the 10th of this month!! We are taking the class and spending our cash right now. I used my pay check to pay our car and home insurance up to about 6 months, and 3 months. I hope that was okay? But now what? If we file with little cash in the bank, will they ask for our bank statements after the filing date?

    We are not paying debt, so we will have cash available every week of course. We paid our attorney, now we need to save for a rental house or apt so when BOA kicks us to the curb we will have a roof. Do they look at the cash you will be saving while not paying bills leading up to the discharge?

    Our attorney said we might have some time left in the house, so we can keep it up while we are there, but that means free rent... which is good so we can save, but bad if they will come after it? How do you save for a place then?

    You can save money after you file, and you did find paying your car and home insurance up. You may be asked for your bank statements up until the day you file; they won't after.

    The only thing you might have to worry about is answering the trustee's question of "has anything financially changed significantly after you filed?" This means did you start a new job, or did you lose a job, or were your hours cut?" You can say no if none of those things happened.

    That is generally what happens, but every district is a little bit different. Also, the UST picks cases at random to audit. They probably won't yours, but it can happen.

      Thanks for the input. And nothing has changed really. It is just with no real bills I do have money left to spend until we have to pay rent again.

        Good for you! I would say set $$$ aside for future living expenses and enjoy your fresh start. You're allowed to live 'normally'.
