As some of you know we are going to court in Oct to fight the UST over our mortgage payments.
If we get dismissed, our only option would be a chap 11 (we aren't even close to a 13). I don't have the money to do any type of retainer (I'm not even sure how we are going to pay the lawyer for fighting the UST!), nor is there any excess money to fund one.
I am trying to figure out worst case scenario. If we walk away from the house, we would still need to do a chap 11. Are the same limits on rent and other expenses factored in for a chap 11? We work out of our home, so if we moved somewhere smaller we would need office space (and it ain't cheap around here)
Chap 11 seems like rich people bankruptcy. My lawyer said if we did a 11, we could still keep the house (which is our plan IF we can get it modified). Could we potentially get stuck in between the two and get no bk relief???
