    chapter 7 and pending law suit

    My son is going to be filing a ch7 next week. He also is in the process of filing a law suit against the company he worked for and was wrongfully terminated from. This has not been filed yet. If he does get a settlement or wins this case does he have to report this? Is there a time frame? The chapter 7 will be filed before this law suit.

      I had a friend in a similar situation. Last June she filed a lawsuit against the company she worked for and was told it would take her about a year before the court can decide whether she will be awarded or not. She did not file for BK though. I would suggest that your son asks the lawyer about this impending lawsuit he is going to file and how this would affect his CH 7 filing. Best wishes!

        Does he have to report this when he filed this law suit. How much time can go by before you have to report it? It could take 18 months before he knows if he will get a settlement and it might be 2 months before this is filed.

          At my 341 meeting, that was one of the few questions the trustee asked about, if I had any pending lawsuits.
