    EEK! Debtmonster, you might want to run out and make sure that bmw is still in your driveway

    ETA: It seems that BMW's 2007 and newer automatically come with BMW Assist. I would think they could easily track the cars where abouts via this system EEK!

      You are mixing up what I said. I switched attorneys because after I gave that other attorney the money, she was more. The total for her was $4500. The total for the new attorney was $3000. The old attorney gave me most of my money back and I used it. The old attorney told me she was swamped and it would take at least 2 months before she would get time to file my paperwork. This new attorney did it lickity split. He just happened to tell me not to worry about the car. The previous attorney told me to give the car back right away. The new one said to keep it and keep driving it and he offered to fight for me to keep it as long as possible.

      I told all of you this and then you all came down on me saying that I will have to give the car back. So let's assume you're right. Why am I not permitted to have a contingency plan? And then I have to get grilled here for telling people about having a contingency plan.

      All I can do is hope for the best. If this attorney can keep me in my car for a long time after discharge, that will save me a ton.

      I am tired of this playing by ear crap. I just wish I knew the future and had all of the facts.

              Great! Then tell me the exact date I will actually be required to give my cars back.

              Also... what happens if you refuse to give your cars back after the bankruptcy? Has anyone ever done that? Let's say they called you to pick them up and you simply never called them. They can't sue you, right? Because you just went bankrupt on them.

                I haven't done that, but it goes a little like this.

                If your case isn't closed, they can file a Motion to Compel Turnover of Property and then you'd be in Contempt of Court if you choose not to follow the order. I don't believe they could re-open a closed case to pursue it in the Bankruptcy Court. They can go to State/local court and get an Order of Replevin to compel turnover.

                Suffice it to say that at some point, they will seek a remedy by asking some court of competent jurisdiction, to compel you to turn it over, or face sanctions for contempt.

                              LOL.. I don't see a problem with that.. In Detroit, they are releasing prisoners who go back out and commit crimes upon leaving the jail because they don't want to be homeless.
