    has ANYONE been able to reaffirm/re-sign mortgage?

    The mortgage companies seem so busy and so stuck in no-mans-land!! They don't want the house, they don't specifically WANT to foreclose, but they have their thumbs up their ------ and draw everything out forever . . .

    Has anyone actually got THRU the big mortgage machine-press 1 five times- press 0--talk to 4 different people and been able to reaffirm their home?

    I spoke to Wachovia today and the rep said " we are doing tons of modifications" for whatever its worth.
    Very fortunate in the grand scheme of things but have learned my lesson.

    Filed 12/15/08, 341 1/12/09, Cont to 2/12/09, cont to 3/12/09, cont to 4/15/09, cont to 5/11/09, cont to 6/02/09. Discharged 9/16/09, Closed 10/23/09

      I heard that a lot of mortgage companies won't do reaffirmations. I have no idea what the reasoning for this is but I've never understood "big business"

        All I can say is, if you want to get a modification done during the BK, get it in to the mortgage company RIGHT AWAY.

        If you start one too early- before filing, alot of them will stop it.
        If you start one too late into waiting for discharge, they will mess up.

        We submitted ours a month ago- about a month after our 341. They promised us we would hear back in a week. Three weeks of pestering later, they just looked at it, we played "lets make a deal", got a deal and were told it was contingent on NOT being discharged (meaning an actual reaffirmation), and found out that night on PACER that we were discharged. Since that was 2 days ago I am still trying to find out if we can still "get a new loan" since we can no longer reaffirm.
        4/27/09- 6 judgements, 2 liens, 3 bank levys later ... 2nd lawyer visit. 5/4/09- Paperwork done. 5/14/09 signed, filed Ch7. 6/23/09 - 341 meeting DONE!
        8/25/09 - Discharged! 8/27/09- Closed!!!

          this is all lender specific. I have been trying to get my loan modified since April. They have been dragging thier feet. I filed 8/6 and they are still processing my modification. It has not caused them to stop. Actually I think it may have pushed them faster. The idea is that before discharge I will sign a NEW promissory note on a modified loan which will bind me to the new terms.

          Bottom line talk to your lender. There are no "one size fits all" rules in this new economy. Good luck!
