    Just Discharge as of 08/20/2009

    I was just discharge last week but I received a call from the paralegal of my mortgage company stating they did not receive my reaffirmation agreement. He wants to send me another agreement to sign. Initially, when I signed the first agreement I didn't like the ARM option but I was alittle scared to reject the agreement because I'm doing the bankruptcy myself (no attorney). But know I was told that I could of negiotated better terms on my mortgage. Is it to late to negoitate a better term for my mortgage? Should they be asking for this agreement know after the discharge?

      Are you asking about a house or car? This sounds like a house. I am by no means a mortgage expert. Let's hope somone with more knowledge responds. Otherwise I will make a new thread for you in the 'Collections' or one of the other Boards.

          Since your bankruptcy has already been discharged, I believe it's too late to enter a reaffirmation agreement as a part of your bankruptcy now.

          However, once your bankruptcy is officially closed, there's nothing stopping you from working with your mortgage company to renegotiate your mortgage at that time.

          And congratulations on your discharge!!

              It is too late. Reaffirmation has to be signed and on file with the BK clerk before your discharge.
              4/09 Converted to a Ch 7 due to loss in dh's income
              5/09 UST now involved no idea what happens next
              7/09 UST has decided to withdraw his motion to dismiss!
              7/27/09 DISCHARGED!!!
