    Wife filed last year--concerns if I need to..

    My wife and I were married in 2007. Our credit and assets were always separate since we got together later in life. Since she was out on maternity leave, she was able to squeek by with a chapter 7 with my last income.
    She has been discharged. I have been recently layed off and now I may have to file later this year. If I dont line up employment by nov - dec, I may have to file chapter 7. My concern is the following:

    1) Will it trigger a flag if I use the same attorney? What about the clause "was a attorney consulted before charges incurred"? They can say that I meet with an attorney at the time my wife filed. Note that I do have a $6,000 charge a few months ago for an AC unit on the house - also a few grand on the home depot - no payments - no interest for year for mostly kitchen / plumbing repairs. These are not due until like march - april 2010.

    2) I did file Chapter 7 earlier - back in 1992 - does this trigger any sort of flag?

    Nothing wrong with consulting an attorney prior to filing. Most of us did that. It's your conduct after the consult-did you go out and charge up a storm on cc's or, attempt to transfer ownership in property,etc.
    I'd hold off filing until 6 months or more have passed since the charge for the AC. AC is pretty much a necessity so I doubt that individual charge will raise any eyebrows.
    You will have to disclose the prior bk. It was along time ago and I doubt the trustee will have any interest.
