    UST is very quite before court date

    Hi All-

    We are going to court in Oct (the bk system is logjammed where I am) on our house mortgage payments. Last week was the last day the UST could request info for discovery. We haven't heard a thing from her.

    Since we have an actual court date, is there any chance the UST will still withdrawl? I don't know if I can wait another month for this to end!

    The UST may withdraw after reading your objection. I'm assuming your lawyer has already filed that right? If it's convincing then the UST may back down. That's what happened in our case.

    7/09 UST has decided to withdraw his motion to dismiss!

      Our lawyer filed the objections about 6 weeks ago and the UST wanted a judge to decide our fate. Since she is so focused on the house payment, I wonder if that will be the only issue she brings up and that's why she is so quite.

      Can the withdraw after the court date is set, or is it frowned upon (like wasting the court's time)
