More Pacer Questions

I rarely check Pacer so I am not one of those checking every 5 minutes. I have been checking once a week now that I am getting closer to my date.

Today is supposed to be the last day of objections. In Pacer, the date last updated is still 7/28 which is when my pre-discharge course certification was filed. Nothing new since than - in fact it still says 341 scheduled, status MEANSNO. Nothing else. You think it would have been changed to something else - I mean, I had my 341 2 months ago of course. Why don't they change that part?

But here is my question: If the court sent me any mail (like a letter for a problem with my case) is that entered into Pacer too? The reason I am worried is that the dumbass USPS has screwed up my mail since the beginning of August and was sending my mail back to the senders saying I moved.. It took me since last week to get it straightened out (Short Story: THEIR fault - of course) but I am still worried that the problem could still continue.

So I have been worried that important mail such as things from the BK court have been sent back to them or mail back to my lawyer (my lawyer's assistant is a real flake and even though I gave her my new phone number back around the 341 - she still tried calling the old one so if something got sent back to them who knows if she was calling the right phone number to try to contact me!). I am going to call tomorrow to check (tues is the only day I can get a hold of anyone there) if they received any mail returned to them and make sure they have been trying to call the wrong number.

I know it can take longer to get my discharge than the 60 days but because the post office screwed up I am concerned that I missed something I was supposed to take action on.

I know I am probably freaking out over nothing. But this is too important to be screwed up at the last minute because of the f-ing USPS can't do their jobs right. I already had other mail that was important get sent back. I can't have this be screwed up too. I have already been losing sleep over the rest of my mail being screwed.

Isn't it sad how our lives can depend on the whims of the Postal Service? (I really wish their was a good competitor - I would switch over in a second).

USPO for the most part is efficient. For 43 cents you can send a message anywhere in the US? No competitor could stay in business for that price.

Sorry about the address problem but you might turn in a change of address card with both old and new the same. I might get their attention as they do honor them for some time.

PACER is not expensive and I look twice daily. As long as you look once to every new item, then save it to your hard drive for reference. PACER should put up everything mailed out to anyone. Look at your docket report for updates and a small description of the events. 'Hub

The trustees' offices are backed up with the increased bk filings. Since your case is MEANSNO, that's a good thing. Your trustee doesn't think you have assets, so your discharge is just around the corner.

Any document the court sends out via USPS will show on PACER too. If you don't see anything new there, then nothing new has been sent out.

Did you or your lawyer provide your new address to the court when you moved? If you did, then that's the address the court is going to use when they mail anything out. As already mentioned, just for your own peace of mind, sending change of address forms to your old post office location and your new one is a good idea.

Yes, everything will be in PACER. Follow Hub's advice on checking, but you don't need to check twice a day. I figure at least once every two days is sufficient. That will cost you $0.08 to check the status each time, and should be worth it.

You mean the taxpayers lost $2.8B. The USPS will be in business so long as it is subsidized by the Federal Government. The USPS' problem came from them attempting to compete with the large package and overnight companies. They grew too fast and that whole "We Delivery For You" campaign was nothing but another DOT COM fiasco, if you ask me.

Thanks for the replies guys! Whew! It is nice to know that everything will be in Pacer - that means they haven't sent anything since 7/28.

Oh, just FYI, I haven't moved. That was the problem. I have been at this address since November 08 and I was getting all my packages and letters fine and than all of the sudden, after 9 months of being here, they think I don't live here any more.

No one at the USPS could figure out what happened. The only reason I knew my stuff was starting to get sent back to the sender (Not Deliverable as Addressed - not true the address was correct) was that I had tracking info for a package I was waiting for. In order to get my problem straightened out, it took TWO attempts by the sender of the package to prove that my carrier was screwing up (I still haven't gotten the package yet - third attempt, I am having them send UPS). Otherwise, the USPS people gave me the run around.

My mom sent me a letter that was important that got sent back to her. In order to get it to be delivered here I had to have her put my boyfriend's name on it - THAN the carrier delivered it. But not with my name on it. I even left the carrier a polite note which explained I hadn't moved and to please deliver my things (he wasn't our normal one) which he ignored. I had to talk to two different managers to get someone to talk to him. The carrier supervisor was the only one who could explain to me what happened. They did a route change and instead of moving my current address to the new route they moved my old change of address before I moved here to the route (I am not sure really how this works but that is how she explained it to me) so everything addressed me (except junk mail of course) was sent back to the the sender because they thought I had moved (even though they had a recent change of address for me). My bf and his mom both live at this address too and their mail is arriving fine ( at least as far as they know) and my bf lived at my old address too - so why just my stuff?


Several packages and many important letters. I am still back tracking and fixing it. I will have to spend many hours on hold with the governement today getting another issue straightened because of this screwup.

I am sorry for those of you who like the USPS - I don't. I realize they have a lot of work to do and get tons of mail to sort though but I didn't like not given the correct answers to my issues and was given the runaround (even when I had proof!). Most of the work is done by computers so I don't see how that can screw up a change of address unless it was the carrier.

I was just checking my Pacer Sunday and noticed some additional documents added at the end of the week. Today (Monday) I got the same documents in the mail.

Starting to wonder if Pacer was even worth it, I've seen stuff a few days earlier on there but so far have recieved copies a few days later in paper via USPS. I think it's just my attorney being on top of things.

So that should answer your question. Just like if I typed this up you see it now, and I could print it and put a stamp on it, you would see it either way (usually).

Most things are mailed out by the BNC (Bankruptcy Noticing Center) on Friday or Saturday. That's why you tend to get things on Monday. If you hadn't checked PACER for a week, that's why the mail would be there sooner.

As for PACER being worth it, it is in certain circumstances. If you're a pro se debtor, it gives you more days to respond to any Motion since the mail delivery time is included in the response time for Motions (especially where negative noticing is utilized).
