    Case changed from No Asset to Asset!! When Discharge?

    Had 341 on July 30th. I checked Pacer today and they had this:


    Deadline/Hearing______________Event Filed______Due/Set

    First Meeting Information_______06/30/2009______07/30/2009

    Obj. for Discharge Due Date____06/30/2009______ 09/28/2009

    Proof of Claim Deadline________08/05/2009_______11/09/2009

    Government Proof of Claim_____06/29/2009_______12/25/2009


    So does this mean I will get a discharge after December 25th? Just curious. I know already a creditor filed a claim.

    What made them determine that you were an asset case?

    What is the Government Proof of Claim? IRS?

    We filed 12/28/2007 and had the 341 2/7/2008. Our original 60 days should have ended sometime in mid April, but it got extended until mid-June when we were ruled an asset case. We knew we probably would be because our lawyer warned that we didn't have enough exemptions to cover all of our stuff. Did you get any such warning?

      Another question I have. Is I have a stock portfolio, and its value increased after filing. Will that be taken into consideration in the assets or the value as of the date filed?

        Were you asked if you had any stocks and bonds at your 341? If you said you did, the trustee may be interested.

        While we answered 'No' to that question, I did hear the trustee ask others. I don't remember the replies.

        I do know that he told people who were expecting 'Stimulus Checks' from the IRS to check with him first before cashing them.

          you would still get discharged sometime after sept 28. but your case will remain open for the trustee to administer your assets (i.e. the trustee would make payments to creditors).
