Okay... Would it be wise to call the bank that is handing my modification on my second mortgage (only 1 year temporary) and tell them I plan to file for chapter 7? Reason is an attorney just emailed me and said that with temporary mods they will be void if you file bankruptcy unless they are permanent. I have to disclose this or when I file they will want all of the money they forgave in the agreement if it is void. Please someone tell me if this is the thing to do. I'm already behind.

I really think this all depends on the mortgage company. I have been trying to get my loan modified since april. Finally I could wait no more and had to file my bk. when i spoke to the mortgage company and told them that i was filing and asked how it would effect my modification request i was told it would be moved to the bankruptcy dept and they have the ability to modify and then i can reaffirm. a week later i received a request for more info overnighted and a making home affordable application to send back. Im hoping this means they are actually going to do the mod while I am in bk so i can then reaffirm on the new loan...
I think with how messed up banks and the economy right now nobody can say for sure. call your mortgage company and ask them.
