To try to make a long story short, hubby and I got into a deal with my dad to purchase and share a summer home. We paid him most of the money back with 7% interest and then were going to pay the rest with the proceeds from our primary home when it sold. He agreed to that but not to the final payment amount. When our primary home didn't sell in this market he sued and put a lien on the house. We didn't fight the lawsuit because by then we had moved out of state and were not receiving the court notices in time to attend them. He then contacted my husband's work and tried to garnish his wages, which if we allowed to happen would bankrupt us. We contacted a lawyer and he suggested going BK. My dad then hired a lawyer in the state we are living in and sent him to our 341 and he contacted the UST. We dismissed our case and have since refiled and his lawyer showed up again and did the same thing. His lawyer knows he cannot win on a creditor objection so his next best thing is to get the UST involved.
Since the posting of this thread the UST has once again filed a statement of abuse (not surprisingly). I guess it is decision time. We see our lawyer tomorrow and will weigh our options.
I am an only child and my mother is dead, so it was just me and my dad, and we haven't spoken to him since this whole thing start approx. 4 years ago. He also hasn't seen his only grandkids, who have since graduated from college. Yes it is sad but it happens and he has virtually ruined our lives. What more can I say?
