Listen to your attorney. Stop worrying.
Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

Well, I'm done worrying but it did provoke a discussion between the Mrs. and I in which we decided to let the minivan and its huge payment $550 go, find a way to fit all the kids safely in the other car and pick up a cheap runner to replace the minivan.

Chrysler and Ford are renowned for not allowing ride-throughs.

I think I'll be renowned for never dealing with Chrysler again.

Update: we didn't object to the filing, so they filed a Certification of No Objection today. I'm told this whole thing will delay our discharge by at least 10 days...which bites, but at least our status is still "Awaiting Discharge". I'll be so relieved when it's all over [continues praying].

Anyway, I called Chrysler Financial myself and told them they can have the car back. How nice am I? I'm even dropping it off to them on Wednesday, then picking up a high mileage runner for cash (elsewhere). I'm excited about not having that car payment.

this is what we did too. We were two payments behind and knew we would be filing BK in the next 60 days so we dropped it off at the dealership. locked the keys inside (it was at night) and said our good-byes. I sure don't miss that monthly payment

You can get a decent minivan for under $10,000.00 if you need to. We just bought a 2006 Dodge Caravan with 33,000 miles on it for $8,500.00. It doesn't have all the bells and whistles, but it runs great and fits all three kids in carseats. We are going to buy some headrest dvd players for the kids. we saw a system that was around $400.00 for dual dvd players. So that is an option for you if you want to buy a bare bones model and save up for a couple months and put in the players for the kids.

Good luck on your car hunting!

I called the Finance guy at the local dealership to tell him when we'd be coming, and he was a complete tool.

The only thing that worries me at all was that there will be a form I need to sign that I guess says I'm returning their collateral. I guess I'll just read it carefully before (or if) I sign it.

We have money saved, and put some down on a used Ford Expedition (we're a family of 7 in an area that gets a LOT of snow.) Less than $10k.

Good for you - we dropped our car off at the dealership also. Felt good and we were able to begin our fresh start debt free.

My suggestion is you call Crysler bk dep't and ask them what is their intention.

You guys are crazy with all the new cars.

I make good money as a consultant, and I'd never buy new at 20,000 what I can get 90% as good for 8,500.

I had to dig out my attorney's paperwork on the "aggressive 2 car loan companies"...
Ford Motor and Chrysler Credit tend to insist on reaffirmation and (according to my attorney's paperwork), Ford Motor has in fact repossessed some vehicles after the bk was concluded eventhough the loan was current...

I say give it back to them. Good Luck!

Personally I would not sign anything. Realistically you don't even need to speak with the dealer. Leave it at the dealership and advise Chrysler where to go pick their POS vehicle up. Remove the plates and hand them the keys. If you do plan on signing anything, I would read over it carefully, just in case the deal tries to get you to sign something about the condition of it and so on. You filed for bk and are handing it back. It's Chrysler's problem now.
