    filing BK for 83 y/o mom

    Can someone point me in the right direction? I dont think I should get a lawyer, she has no house or property, just too many bills on a fixed income. Are there any software titles out there someone can recommend? or where I can get forms? SIMPLICITY is KEY! LOL as I am in the middle of trying to modify my ortgage and that is taking MOST of my energy.

    Hi bittersweetm: Welcome to the Forum. I moved your post into it's own thread so it would get the attention it deserves. I also deleted your name. It is not good to use a real name in a public forum.

    As to your question for filing yourself, a good source is the Nolopress.com book on filing Ch7 yourself. It costs around $17.00 for a downlodable PDF version that you can print as you need. There are also coupons that some of the other members have used.

    Also read the posts in the Pro Se (Pro Per) Filing board. This is for the members who are handling their filings themselves without a lawyer.

      To add to Mrs. C. post. Get a "Durable Power of Attorney" from your Mom so that you can legally do her bidding. Under her circumstance you may not even have to bring her to her 341, as you can legally stand in for her. Or if that isn't feasible, a telephone hearing can be done from the 341. This is done in many Court cases. 'hub

        You need to do two things; first consult with an elder care lawyer as to taking care of your mother and obtaining, as AngelinaCatHub states, a power of attorney to take care of her financial matters if your mother cannot handle things on her own. This consult will cost you probably around $75 or so but will be the best $75 or so you ever spent. My mother at 83 was still going strong and taking care of her bills and financial affairs and you need to check with her as to her thoughts on this and protect yourself and herself by getting proper info from an elder care attorney. The info is priceless. Secondly, after that, consult with a BK attorney (most consultations are free) as to your mother's situation.

          what kind of fixed income is it? if it's SS then she is totally judgment proof and there is no reason to file bk. just put the SS in a designated bank account so it remains exempt.

              Just change her phone number and forget about the creditors. Talking to them will not help, they are in India and have a script which only says "you will be sending payment now"...
