    rent cheaper than mortgage..

    but I'm not paying the mortgage SO which figure do I claim? The amount I pay in rent or the mortgage payment that killed my acct? What if I moved into a cheaper place before I filed or what happens if I'm inbetween places? I thought if you weren't paying a mortgage or rent then you have to claim a "standard" cost for living in your area. I think my brain is going to burst..

    My brain might be fried too Friend LOL! We are not surrendering our home; however, have read many posts on foreclosures. Hubby said I used to be addicted to Pogo (an internet game place) & now I'm addicted to BKforum. I just smile at him and say 'Well, at least I'm learning on BKforum whereas on Pogo I piddled the day away playing games. I'm 100% disabled, so not too much I can do.

    It is my understanding if you have moved out of the home being foreclosed and already renting an apartment, the monthly rent is used.

    Now, to those who just moved out, just stopped mortgage payments & moved with a lesser amount of rent trying to do the 'right thing'...To me that's not fair. But fair doesn't count in Bankruptcy And some of the IRS rules doesn't even apply the same in Bankruptcy...go figure LOL!

    Hope you have retained an Attorney. If not, call around and get some Free Consults if you have the time. They should know the answer immediately.
    If you have an Attorney, you might want to call and ask.

    My communication with our wonderful BK Attorney is through emails. Much faster for him and me also. I try to only email him questions every two weeks. In the meantime, I write them on a notepad or I will forget. He usually will reply back within a day or two.

      Our lawyer used our mortgage amount $950.00 then noted that we would still need to rent a home(rent would be approximately $1200-$1300) after the current home was surrendered and that rent would be more than our mortgage(our house is a falling apart money pit so the repairs made keeping our home more expensive than renting).

        In my case, renting is cheaper then what i was paying for house, that i surrendered in my Bk..
