Thanks all, the other posters have covered my reasoning very well. I did not have time then to go into detail.

I wish the OP all the luck.

It also will matter if you child has been in private school for a number of years. I had a 11 year old that had been in private school since 4 years old.
Starting at 6, first grade it was 18K a year.
Now my BK was a non-consumer debt so the means test didn't come into play. But there was never a question about the 18K a year tuition bill.

Good point. Yes, she is 14 and has been in private school since 6, so 8 years of private school.

I listed a similar amount for private school tuition on Sched. J and filed pro se and the trustee didn't question it. I also live in the Bay Area, CA where private school is almost a necessity in a lot of areas. She has been in private school since PreK except for one and a half years when we lived in a good school district. So if he did ask, I could have explained that we lived in a bad school district and we had always done private school. My DD was 9 when I filed (4th grade).
Filed Ch. 7 Pro Se: 12/11/08
          341 Meeting: 1/7/09
Trustee's Report of No Distribution: 1/9/09
          Discharged: 3/10/09
