    "failure to obey court order"

    Due to several personal reasons we have only made $700 worth of chapter 13 payments out of the $5610 that we soon should have made. We were anticipating dismissing this chapter 13 and filing a chapter 7. The new attorney we plan on using told us yesterday that we would have to wait 180 days after the 13 gets dismissed because we basically failed to obey a court order by not really making an effort to send something every month. Other lawyers we talked to didn't think this would be a problem. Any thoughts or experiences would be greatly appreciated.

    Well they all may be correct. IF you have a good reason not to pay, and IF you can convert to a 7, then it may slide by. If you were shown in your confirmation that you could have performed, and did not, then the lawyer may be correct. Can you share your reason for not paying as agreed? This may help with more information to us. 'Hub

      wife and i were living apart for a bit and no one was able to make payments but now we are trying to work things out. conversion is not an option because of a previous chapter 13 we had in 2003
