    last week the bank acted like they didnt want my truck. then today while I was asleep{work 3rds} the bank called and asked if they could come get it..my wife said ok.
    well I woke up and my truck was gone and my wife told me what happened. I thought during a automatic stay a creditor could not attempt to collect anything? and my wife not knowing any better let them take it. is this going to cause me any headaches now? also we surrendered the truck in the BK and my 341 meeting isnt until sept 11. now Im starting to stress thinking this will cause me problems being that my wife told them to take it.
    I tried to contact my attorney about this but of course couldnt get ahold of her.

    They shouldn't have contacted you. They were in violation of the automatic stay. Will it cause problems? I can't think of any reasons why it would. I hope they left you some paperwork when they took the truck? If your intentions with the truck come up at your 341, you can simply say it's already gone. Make sure to have the paperwork with you to back that up. And don't forget to cancel the insurance!

      they didnt give my wife any paper work. that was the first thing I asked her. she said it was 2 older gentlemen from a local auction house. she said the CU called and asked if they could come get it and then 20min later the repo guy called and asked a few questions and 10min later they showed up and drove it away. atleast she had enough common sense to get all my stuff out of it first along with the plate. and I canceled the insurance already. yay more stress!

        also forgot to mention this is the same CU we have our mortgage through and our lawyer says they like to show up at the 341 meetings. I wrote down the names,numbers and times from my caller ID. is it normal for repo people not to give receipts or some sort of paper work when they come to get a vehicle?

          I think I'd consider calling that auction house if that's possible and ask for something black and white to prove you're no longer responsible for the truck. Glad she got your personal items and the plate. Sorry it turned out that way for you. We have to go friday to turn our surrendered vehicle in. We were discharged on the 5th. Got the discharge papers on the 10th. GMAC called on the 10th asking when they can come get our car. They agreed to let us take it to a local dealership Friday to avoid having our nosey neighbors watch a tow truck marked "RECOVERY" come take away my beloved car. They didn't waste any time contacting us post discharge but at least they didn't violate the automatic stay. I've already cleaned out the car and I hope I remember to take the plate when we go drop it off.

              yes my wife removed the plates and took all the papers and what not out of my glove box.
