    Hi there!

    My husband and I finally signed our papers at the lawyer's office for chapter 7 today! Although they said we have about 80% chance it still felt soooooo good to know that we are getting closer to a fresh start! I'm hoping for a smooth 341 hearing which will be sometime in September !

    09/14/09: 341 Hearing
    11/13/09: 60 Days from 341 Hearing

    An 80% chance of what? Is you lawyer thinking there's a chance your trustee or creditors will have objections?

    I'm hoping for a smooth 341 hearing which will be sometime in September !

      Our income was over the median so they had to do some kind of additional test (sorry for my lack of knowledge) and they said we passed by $29.00. Our situation is a little tricky right now due to my unemployment that is to be discontinued end of this month and my pregnancy. Also my husband has a 14 year-old who we do not claim on our tax return but spends 4 months/yr with us and we can't count any of those expenses (food, air fare (she lives out of state, clothing and etc.).

      I hope it all works out. Being pregnant and dealing with the BK is not easy at all!

        Best of luck to you. I can tell you that it was the months leading up to filing that were hell. Once I filed, I felt fantastic....

              Congratulations! I just filed last Wednesday so I know how you feel. It is a huge relief, like maybe, just maybe there is a light at the end of this horrific tunnel!

                5/09 UST now involved no idea what happens next
                7/09 UST has decided to withdraw his motion to dismiss!

                  Thank you all! We tried to file a couple months ago and we were told we had to wait until my unemployment ran out to help qualify for chapter7. It's been really difficult as we were behind on both our car payments and one of the creditor started sending out a repo truck. We lost many nights of sleep worrying that the neighbors will hear/see the car repossessed. Also we were told by the lawyer that we absolutely had to have the two car payments as expenses when we file in order to qualify so we ended up parking the car at our friend's house.

                  Now we can sleep without worrying about our car taken away. Well, at least for a little while. As soon as the hearing is over we intend to give the car back so that we only have one car payment and pay less auto insurance. I'll just have to be the family driver until we can save money and afford something that cost less. We might end up getting a used motorcycle for my husband so that he can use that to commute in the meantime.

                    My husband and I will be filing Tuesday. I thought I had a handle on my emotions but the closer we get to filing, the more anxiety I feel. Hopefully, I will get some relief after our 341. Anyway, congrats and I hope things work out for you and your family!

                      I filed last week and it actually was a relief. There are still a lot of emotions flowing through me, but it is a huge help to know that my bank accounts won't be seized, etc....

                      I think after my 341 is when I will really start to feel better.

                          Can you count a daughters school expeses in the means test?
                          and still count her as part of the household ie herd dorm room food and books and school tuition?
                          my wife has been unembployed for a year and i have been paying all the bills on my income she has a lot of unsecured debt so we have her file alone.

                            Needhelphere: Congtratulations on getting filed. I know it must be an awesome relief. Will be praying for smooth 341!

                            Trying to get our paperwork complete thru 8/31 and we will be filing on 9/30/09 as it is a small city & our BK Attorney files all his cases the last business day of the month.
