    I chickened out....

    GE Money kept calling me. I finally called them back and told them they could call the attorney i have retained. They asked If I was filing for bk? I told them call the attorney and to talk to them. They kept asking if i was filing and I was like I dunno call the attorney.

    Should I have just told them? When I said he should call the attorney he got all happy and was like are you filing bk? Then he was if you are i need to make a note.

    I guess its ok to tell them if im filing in 7 weeks?

    Ugh.....I just hate admitting the fact but I know this is my only option.

    Also should I even be calling creditors to tell them or wait till they call?

    I told every single collector who asked what chapter we were filing and gave them our attorney's name and phone number. Not a problem, actually it worked in our favor, they left us alone longer once the attorney confirmed that they were representing us and what chapter we would be filing.

    Yes 7 weeks is fine, we told our cc, who then sent it to collections, we told collections, who then turned some of them over to attorney's who we told the same thing. This went on for a year and a half before one finally filed a lawsuit, which they won when we didn't appear, and THEN WE FILED!!! So we told the truth, just didn't give them a date.

    And don't let feeling bad eat at you, it won't help. The first time I admitted it to the first collector, it was tough, but then it just got easier and easier. I told all of them we just couldn't do it anymore and they accepted that and not one single one of them gave me a hard time. I even called all the 800 numbers on my phone when I got home from work, otherwise I knew they would keep right on calling. I told each and everyone of them the truth, maybe that's why they didn't give me a hard time.

    I should also add by answering the calls and responding to each collector we had long periods of time with no calls, I am talking about months and months. It almost got to the point at times, I thought they forgot about us, so don't worry, if you have an attorney who will take the calls, then you will be fine.

      I called my credit union last week to advise them because I have my car loan thru them and honestly I dont want anything to happan to it... They were very pleasant and thanked me for warning them.. Maybe I am just in denial and they laughed after they hung up but I am choosing to think I did the right thing. Every other creditor I could give 2 hoots about. They call my house everyday and until I retain the attorney on this Thursday I will keep ignorning there calls... The just dont give up !!!!!!!! EVER

        If you are filing in 7 weeks, I see no problem in telling the Creditors when they call that you are filing Bankruptcy. The next question, they will ask is if it is a Chapter 7 or 13. If you know it will be a definite Chapter 7, tell them. I think it's better to let them know, as it might stop them from filing for a Judgement or some similar case against you.

        We told our creditor last Oct. we would be filing in 1/09. Well, after researching this wonderful forum, I realized some monies I was receiving would be deemed income and would put us over our State Median. Granted we wouldn't have enough to fund a 13, but I didn't want to be scrutinized by the Trustee or the US Trustee.

        So, I let them know when they started calling in Feb. that we hadn't filed because I had skin cancer (which was a lie). I got a letter last Fri. from a local credit company stating we had 10 days to reply or they would pursue with a legal matter. I called them and gave her our Attorney's name and told her we would be filing this quarter (which we are on 9/30/09) and what chapter and gave her our Attorney's name. She asked that I call her back when I had the case #.

        I wouldn't call them, but if I were in your shoes, when they call I would tell them. Keep a log. Once you have given the info, if you receive another call, then I wouldn't answer it. They have the information and all they will be trying to do is to try to get more info for you or press you for a payment. They all have scripts on what to say.

          I never called any of my creditors. I waited for them to call me.

          Whenever they'd call I'd just let them recite their little speech about how late I was on the bill and how much I owed them and if I would like to make a payment today blah, blah, blah...Then when they were done I'd say, "I'm in the middle of filing for BK right now. Let me give you my lawyer's name and number."

          Most of them would ask what Chapter I was filing...which was fine. I didn't have a problem with that. But some wanted more information like when was I filing, was I filing single or jointly, was it an asset or no-asset case. Those kind of question I told them to call my lawyer.

          They were all very nice and never pressured me to give them any answer I wasn't ready to share. They would just say okay, have a nice day and then hang up. The whole process was pretty easy. At least for me it was.
