    I am glad nobody took pictures of me at my 341,* my bright pink feather boas where sticking to my lipgloss and I had feathers all over my face. my leather pants were giving me quite the murph, and one of my stilleto heels broke and I was lopsided, one leg six inches longer than the other.

    It just wasn't a good day!
    But I would have signed a release for a little cashola!

      Since state law governs these matters, there is no one "law" that governs whether a release is necessary or not.

      Since you plan to post whatever photos or video you take online afterwards, I suggest you take a read through The Publishing Law Center's "Publishing a Photograph: Is a Release Required?" at http://www.publaw.com/photo.html . You'll note that their recommendation is due to the ambiguity of state laws regarding the right to privacy vs. the right of a photographer to photograph, "Because there are many nuances to the right of privacy and publicity laws it is advisable to always obtain a written release from any individual that would be recognized in a photograph." (Their emphasis)

      If you're making a movie and gaining profit, then signatures are required.
      Wrong. It's a common misconception that only if you are doing work for profit that releases matter. Again from the Publishing Law Center - "If you decide to use a photograph without a release make certain it was obtained without trespassing on private property, that it does not violate an individual's right of privacy or publicity or that it is protected by a First Amendment use." Do you know your state's laws regarding privacy? Are you absolutely certain you aren't violating First Amendment use?

      I'm a serious amateur photographer who sells my work occasionally. I've done many, many hours of research and reading over the years to understand what's allowed to be photographed and what's not. Bottom line is that out in public pretty much anything goes as long as it's within the state and local laws where you are shooting. However, things change dramatically when you move out of a public place into a private location where individuals are not expecting to be photographed, especially when the federal government is involved.

      So go ahead - sneak a camera in and photograph away since you are so certain you are right. Just be prepared to be stopped if you are witnessed with a camera or camera-ready cellphone taking photos in your 341 without prior permission from the bk court. Great thing to happen right before your 341 and meeting your trustee - excellent plan! (picture me shaking my head in disbelief here)

          That picture would have been a classic! Maybe good for www.lolpix.com

          Look at the thousands of pictures on there. I don't hear about any lawsuits for those, or the ones on www.evilmilk.com.

            FWIW, the notice I received from the court scheduling my 341 hearing says in bold letters at the bottom:

            "No unauthorized cellular phones, cameras, recording devices, weapons, pagers or other portable electronic devices are permitted on the court's premises"

                At least I've been able to make the mortgage payment, Dh's truck payment, utilities and paid $6,000 worth of medical & prescription bills since January and be under the State's Median Income by about $5,000.

                      Just want to add something about zero balance CCs...

                      Going into my BK I had five zero balance CCs; one was a department store VISA and the rest were store account CCs. I was discharged a month ago and so far all of my zero balance accounts are still open. None of the zero balance creditors were including in my matrix.

                      I don't care about the store account cards whatsoever. They could all close tomorrow and I wouldn't care. The one I care about is the department store VISA. Since filing back in February, I called the toll-free number for that card once a month or so, waiting for the day that it would be closed, which has not happened yet. After my discharge I tried using it and the card was declined so I called to see what was going on. I found out that I never activated the card so they activated it for me. When I tried using it again I was, again, declined. So, I called back. They never told me why it didn't work the second time but I was on hold forever with them. They said they fixed the problem and that the card should work fine, which it now does.

                      I want to mention that all of the zero balance accounts that remained open had a drastic credit limit reduction. One of the store accounts was lowered to $100 and all of the others, including the VISA, were lowered to $500.

                      I understand that it entirely possible that every single one of the accounts could be closed next week. In the meantime, though, I have set up my cable bill to automatically be billed to my VISA so that I will pay the VISA instead in an attempt to rebuild my credit.

                      I'll just have to sit back and wait to see what happens.

                        Hi Cupcake,

                        I've read from a few posters that some of the credit cards make it AFTER filing for BK. I've also read (I think it was Flamingo) that after a couple of years of a card being open (zero balance at time of bk filing), they decided to close it. I hope your "card" survives, it's a great step to rebuild your credit history.

                          Well be wary even if they do stay open... I made this wonderful post a while back about Bank of America letting me keep my VISA and even had a letter proving it (I posted a screen shot of it)... they even stated we recently noticed you filed for bankruptcy however we are allowing your account to remain open at a 500 dollar limit providing you continue to make payments.

                          I was overjoyed. I called the automated number shortly after to "check" on the card and hmm "account number not recognized, please re-enter your account number". So, I talked to a specialist and they said oh yea that account is closed. And I'm like huh? And they said they closed it cause of bankruptcy. I asked them about the letter they sent me...he said what's the date on that letter? I told him and he said "oh I'm showing that on the day after that letter we sent you another letter saying that it was closed". I of course never got the second letter.

                          So, in my head I swore I could hear that horrible music they play when someone plays a trick on you... that wah wah wah wah.

                              It's a Macy's StarRewards Visa and the financial institution/card issuer listed on the back is Department Stores National Bank.

                              The other cards that have survived so far are:
                              Nordstrom
                              Neiman Marcus
                              QVC
                              Macy's (store account)
                              CH7 Filed 2/26/2009 (no asset)
                              341 Meeting 4/7/2009
                              Discharged 7/10/2009
