Does this seem like OVERKILL from my lawyer???

    Okay, I feel much better now knowing that others were asked for the same list of info

    Thank you again for all your replies! I guess it just hit me how quickly that I have to file (>3 wks) and I'm not ready . I thought that my home would sell or the foreclosure date would get pushed or that I would land a job (all possibilities due to interested buyers and a job interview in the works), but so far, everything has fell through and now here I am in a crunch .

    I didn't like any of the lawyers in my area that seem to specialize in BK, but I'm also somewhat leary of a 'newbie' to practicing BK law. Each lawyer that I spoke to seemed to contradict one another and this new lawyer just seemed to match my personality.

    Fortunately, my case is not complicated (no asset and/or exempt) and I definitely pass the means test for a 7. I'm in a non-disclosure state and Zillow doesn't have a Zestimate for my home, so I hope that a BPO will suffice and just maybe I can get an agent to do it for free !

    Hmmmmmm???? Now if I could just find that link to all the online BK approved counseling classes or the posts where everyone tells who they used and how much they cost ?????

      Thanks for that list. I haven't seen the attorney yet, but this is helpful in my preparation.

        Our lawyer asked for all that also. Sounds right to me!
        4/09 Converted to a Ch 7 due to loss in dh's income
        5/09 UST now involved no idea what happens next
        7/09 UST has decided to withdraw his motion to dismiss!
        7/27/09 DISCHARGED!!!

          Here is the website for your bankruptcy classes:



          If you State has more than one district, 'Google' (my best friend) your city,state and add bankruptcy on the end. Google should bring up your District/State's website.

          In Arkansas, we have two districts...Eastern and Western.

            That was ONE piece of the puzzle that I was looking for!!! And believe it or not, I spent several hours yesterday "Googling" for this info and doing searches on this forum (besides the fact that I already checked my state's BK site).

            But I know that a bunch of posters on here were discussing what online course they took and how much it cost, and I just couldn't find it for the heck of me !! I was hoping someone else would find the thread that I somehow couldn't .

              Find a different lawyer, this guy seems clueless from the info you provided.
              He should have provided you with this also.

                Zillow is currently estimating my house to be worth nearly twice what it is in reality. The builder who built my house built 3 other houses just like it in 2005 and he hasn't been able to sell ONE SINGLE HOUSE since 2005. And 2010 is right around the corner. Those houses have been vacant all this time. He's been paying the property taxes on all of the houses all these years.

                The thing is, Zillow is making my case look bad. In reality, I'd be lucky to sell my house for $80,000 to $100,000 and Zillow is showing it at over $180,000. The trustee could think I was a liar after seeing this. Zillow is not using the correct comparables for my house. The other houses brand new, never lived in have been for sale for less than $180,000 and they aren't moving at all. Nobody wants to live in the boonies.

                I've been researches houses in South Florida. If I couldn't afford a home up north, I REALLY can't afford a house down here. The property taxes on many of the single family homes is like $5,000/yr. here. That's INSANE! I don't know how people can afford to pay all that on top of all of the other taxes they are paying in life.

                    Virtually EVERYONE hates me because I speak my mind. I don't care what other people think anymore. I have become numb to other people's opinions about my comments. In 90 days we will find out if I am right or wrong all this time in regards to my advice on here.

                          Read the facts Tinfoilhat. LDL hasn't even met this Attorney, just talked on the phone with him several times. LDL was reading the Attorney's website of information requested to file a Bk Case.

                          He can't fire an Attorney he hasn't even hired yet

                            You do realize when you become of age to receive Social Security, your monthly amount will be less than a W-2 wage earner as a sole proprietorship's Social Security taxes paid through a yearly tax return is based on Net Income from Schedule C up to $150,000 in income (which I don't believe you will be making).

                              You are supposed to be paid based on you top 3 years of working. In my top years of working I peaked at $80,000 per year. I got some paper from the Social Security Admin saying that if I manage to live to like 67 years old and not die from diabetes, a stroke, a heart attack or alcohol poisoning before then, I may be able to collect like $1,500-1,700/mo. or something close.

                              So if I can manage to make like $3,000+ per month from some MLM in the future when I become like 60 years old, plus that SS income, then maybe I could live comfortable sitting in some place like Costa Rica, Argentina, Brazil or Peru. Are you down with that? I'll have to give up the fancy cars like here in the US, but so be it.

                                I said find a different attorney. I'm not the internet police and if he doesn't listen I'm not going to hunt him down and arrest him.

                                Thats my opinion, g*****n it doesn't matter what age people are they never recognize an opinion.
