    Maybe someone can answer this

    My husband and I lost our house last year to foreclosure and filed bk on it and the ch 7 was discharged nov 2008. The people that purchased our house from the realtor that handled it, filed bk last month. We would really like to get our house that we built back. How will we know if the trustee is selling the home to pay off debts, would it be listed in local paper as trustee sale? Is it a good idea to try to get our home back like this? How long would this process take? I think form the listing I found that there 341 is this week?

    Just because the new owners filed BK doesn't mean they are giving up the house.
    May 2008 Hired 1st Attorney/Stopped paying CCs
    May 21, 2009 Retained 2nd Attorney
    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!

      Wow, interesting situation... I would ask the trustee directly.

      A friend who is helping me with my BK says the trustee usually just calls a realtor and list it like anyone else.

        check their statement of intentions and see what they say about the house. that will give you a clue into what's going on.

          Yes and please let us know how it goes. However just because they are filing doesn't mean they filing on the house. We filed C7 but we are keeping the house. Good luck!

            And even if they are giving the house back in chapter 7, it wouldn't go to the trustee if they have a mortgage on it. The only way the trustee would be selling it is if they have more equity than they can protect.

            If you are considering getting financing to purchase the home I believe you will have to wait three years after a foreclosure.

            My heart goes out to you, and that would be great if you could get back into your home.
