I know somebody who is contemplating a chapter 7 bk. She has a credit card with Patelco with a 20k limit and 20k balance, she also has a car loan with Patelco. What will happen once she files BK, she intends to keep the car b/c it is worth about what she owes, but does not intend to continue paying the CC. Can Patelco offset the car since they have the title?
