    This week sux...

    We are an asset case with over $4000 in overage we couldn't exempt.
    We have agreed to pay the overage over a period of 1 year...(I know, could let some assets go but it's our debt and $4000 is alot less than we had going in).

    Went to court for foreclosure hearing...gonna have to move out in about 60 days.

    County Code Enforcement sent a registered letter...code violation for a storage container in a residential zone.
    10 days to remove it or $250 per day if not removed.

    Yeah, it's been one of those weeks.

    Oh, almost forgot...
    status-75 days, awaiting discharge.

    Just want this all to be over.

    roozterdvx: I sure do understand. Not only was I over by $5400, but I had to pay a preferential of $5000.

    About the container. Go to your codes and fill out an application for a special exemption. Tell them you are bk and they would not get their money anyway. You are broke. Tell them that the container is because you are moving out and the reason why. (I assume it was for the foreclosure). BE NICE, and they will most likely work with you. If NOT, then in a very nice way, (take names, kick butt) explain that you will then address the City/County board at their monthly meeting. Don't worry, there are ways around all situations. Ask O.J. (LOL but Karma got him). 'Hub

      I am new to this and am having some problems with exemptions as well..One being my house and maybe a car that is paid off. If you go over they will let you keep it and you have to pay the difference?

      Please explain... Maybe there is hope for me..

      So confused about the whole process..

          A bad thing or two, but not a bad week. Any day that you wake up and are healthy constitutes a good day. 7 of those and you've had a pretty good week after all.

          I always get up and make sure that my name is not in the obits in the newspaper...

                True...we do have our health and are thankful for it, (once this is over, we hope to have our mental well being back too!)

                  As I said, we are an asset case. We could not cover all of our assets with exemptions.
                  That said...

                  The "asset worksheet" we recieved from the TT with values after appraisals of vehicles and personal property, (yes, the TT sent someone over to our house), came thru our attny. He included a summary with a list of options.

                  1. Challenge the values set in the appraisals, (tough to prove lesser when done by a professional)
                  2. Give assets over to the TT for auction totaling the amount of overage, (you may attend the auction and possibly "buy" your assets at a lower value than stated)
                  3. Keep the assets and pay the overage to the TT over a period of 1 year.
                  4. Any combination of the above.

                  We chose to keep most of our assets and pay back over the 1 year period.
                  The TT has already listed the vacant lot we own with a real estate agent and if the TT gets no offers within a reasonable time frame, can abandon it and give it back to us, (highly unlikely), or put it to auction. We told our attny that we want to be notified as to any outcome of the property and if it goes to auction, we want to notified as to date/time, conditions and details. We intend to try to get it back at auction, if the price is right.

                  The way it stands now, the listed price on the lot isn't likely to attract any buyers. It will more than likely go to auction, we just hope the opening bid is low...lol

                    Weeks like that do sux. That's some good advice that AngelinaCat gave. It sounds like it's a worth a shot!

                    5/09 UST now involved no idea what happens next
                    7/09 UST has decided to withdraw his motion to dismiss!

                      just had the container moved today...paid a towing company $300 to move it to my uncle's property, (zoned agricultural).

                      I guess it all works out in the end...we included the house in our ch7 and will be moving out in about 2 months. At least this way, we get to keep the container for storage.
                      Once we're done moving around and settle in, I'll just give it to my uncle for his use.
                      We paid $1500 for the container 6 yrs ago and we figure we'll be using it for at least 3 years more so we got our money out of it so to speek.
