    Car Reaffirmation question ?

    How often does a bank choose NOT to reaffirmation ? I'm kinda worried about my car.. I owe about $5,900.00 (2004)
    and the nada tells me the value is $7,500.00 !! Now will i be able to keep the car ? Do you think the bank (chase) will reaffirm ? I tried to log onto my account and i noticed that they have already frozen my account !! Why is that ?? Should i call them to see if i can make a payment when its due ?

    I know everyone say's don't worry , this will all be done with before you know it, but I honestly don't know how much more stress I can take .. My husband says i over react on some things, but i just hate not knowing..

    They always lock you out once you file BK. You'll have to start paying them via paper check through the mail.

    You need to check your states laws. In my state I didn't have to reaffirm. As long I'm current on payments they can't legally repo. Your state may be the same.
    4/09 Converted to a Ch 7 due to loss in dh's income
    5/09 UST now involved no idea what happens next
    7/09 UST has decided to withdraw his motion to dismiss!
    7/27/09 DISCHARGED!!!

      Can i pay over the phone ? Would you happen to have a site where i can look up the laws for Florida ? Or is it posted here on the forms and I'm just not looking in the right area ?

        Here's the Florida code, but I don't think you'll find your answer there.



        How you are allowed to pay is more of a policy question of your bank than it is a legal question.

        Even if you have equity in the car they will most likely let you reaffirm. Any surplus that the sale generates belongs to you. They don't get to keep it.
        Pay no attention to anything I post. I graduated last in my class from a fly-by-night law school that no longer exists; I never studied or went to class; and I only post on internet forums when I'm too drunk to crawl away from the computer.

              I called chase a few minutes ago, and got a recording telling that i can make a payment over the phone, it also told me if i wanted to talk to a bankruptcy Rep to press the star key.. needless to say i hung up lol
