Credit card bill today in mail

I am just a few days away, Aug. 4th from the last day for objections. Today in the mail I got a credit card bill from Kohls. It is as if they don't even know I am in BK.

My attorney's office messed up the address on the intial paperwork. I let them know right away. They said they would fix it. Then at the 341 on June 5, I mentioned this to my attorney, he also took the information with him and was going to make sure the office got it right.

Then in July I heard from Kohls again. I again called my attorney's office and she checked and said that yes they had been reinformed again and not to worry about it. Now here I am days from discharge and getting a statement and bill like they still don't know.

I sent my attorney an email today and scanned my bill both front and back. Should I be worried or is this just miscommunication with Kohls?

Can't say whether Kohl's never received notice or not. You should call Kohl's customer service and tell them that you filed for Bankruptcy and you'd like for them to record your Case Number and Attorney's name. If they say "they already know"... then that tells you something.

Make sure you stay on top of your lawyer on this. They tend to... forget to do things. If you have access to PACER, check the Creditor Mailing Matrix to make sure the address was in fact corrected.

I just checked creditor matrix and yes Kohls is listed and then listed again with the new address.

I am 54 days in status. Last day for objections is Aug. 4th is what shows on my status page and that is what the TT told us on June 5th at the 341. He told the whole room before he started with people.

Sorry just last minute jitters and I just want this over and wanted to make sure I was staying on top of what I had to be watching out for.

kohl's bk dept probably knows by now, but it takes them some time to stop the bills from coming. one dept seriously doesn't know what the other is doing. i got one letter telling me to please cut up my cc and mail it back to them, and another letter two months later telling me they are giving me 5 extra days to pay it each month. that balance has been zero for a while, so it doesn't really matter. however, it does show how the cc company's system works.

If the 341 was in June they should know by now.

I'd call the contact number and inform them of the bankruptcy filing and that they are in violation of the automatic stay of the court. (Give them lawyer name and number, chapter filed, district filed, date filed). Tell them you don't expect to hear from them again.

Then save the 2 letters in violation. If they send another then I might pursue compensation.

Well, if they continue, let your lawyer know and ask your lawyer to send them a Notice of Violation of Automatic Stay. Just a warning letter.

If they continue after the warning, your lawyer should know what to do!

I love my attorney.... I just got this email on a Sunday afternoon no less in response to my email I sent him yesterday.

You have nothing to worry about. The Kohls debt will be discharged, they
just need to get their records straight. I will send them another
notice.

This will hopefully be my week for the happy dance, if not this week, very soon!

Some creditors are just under a rock and take forever to get their records straight.
