    Got a Reaffirmation Agreement Today....

    Well, I was worried that my jewelry store was gonna gripe about the charges we did in the middle of May. They sent a reaffirmation agreement to my lawyer for the balance. It was only for about 2,600 dollars roughly.

    My lawyer advised me to just ignore it... lol. He said in 20 years he's never reaffirmed anything but a car. I was skeptical about including this card before I filed and was willing to reaffirm it because I felt guilty that we had purchased our rings and then figured out 4 weeks later we needed to file.

    Do you guys think I should ignore it? I still have a ways to go before discharge, so I'm thinking that if they really put up a stink I can always agree to it later? Anybody had any experience with a credit card creditor sending you a reaffirmation agreement? Are they just trying to see if I'll bite?

    Wait like your attorney said, see what happens. Worst case scenario, they win an aversary proceeding against you and you would still owe the debt after BK. Just wait it out.

    Edit: Why are they sending the reaff to you and not your attorney? Ignore them for now.

      Nah, I said in the post it was sent to my attorney.

      Yea I guess you're right... its just really hard to ignore things like this because I have always been so good paying my bills regardless if I had to rob peter to pay paul or whatever. So, to just walk away from my bills (even with the bankruptcy) is hard for me. So, now I feel really bad ...but oh well I guess.

      The funny part is I've been waiting for Toyota to send me a reaffirmation agreement and now I get one for something I didn't want!

        Sorry, missed that.

        It would be in your best interest to not sign a reaff with Toyota and just keep up the payments.

          I believe if you are signing a 'reaffirmation' paper it must be signed and filed with the courts by your discharge date. @ least thats what it was for ours...

            I'd just wait it out and see what happens.
            4/09 Converted to a Ch 7 due to loss in dh's income
            5/09 UST now involved no idea what happens next
            7/09 UST has decided to withdraw his motion to dismiss!
            7/27/09 DISCHARGED!!!

              Amy26: If you feel guilty about filing four weeks after purchasing $2600 worth of rings, it could mean your conscience is bothering you. It would me.

              Four weeks before, and you knew you were in financial trouble before this, did you not? Take the stuff back, get a receipt, and let them know you are filing. Do the right thing. 'Hub

              P.S. Also this bit of time looks like a suggestion of fraud.

                Unless you are filing pro se you need to call Toyota and have them send your reaffirmation paperwork to your attorney. They cannot use any others paperwork and they cannot send it to you legally.

                  amy, i would suggest to just wait and see. they might just drop it. if they do drop it and you feel guilty after your discharge, you can always pay it voluntarily if you decide that's what you want to do. if they don't drop it then you can pay it less voluntarily...
