      I can't really tell if your being sarcastic, but its called a Motion. Its filed with the district court along with a declaration and proof of service. You use the court's self set procedure to pick the right day and time of the hearing (eg. 28 days notice)

      The "you may be right but you won't be successful" attitude is kinda defeated when you know how to use the court to file motions for matters in controversy.

        And it is kinda bizarre how so many people that posted in this thread gave bad advice and its frightening to know that many people rely on it or think that these people's opinions are conclusive on the matter.

        It seemed that most of you just concluded that there was no way to get your money back in a setoff despite the fact that the Bankruptcy Code and numerous cases say otherwise.

        In re Dutton, 15 B.R. 318 (Bkrtcy. N.J. 1981) - Court gave back the debtor his money after the bank took the money just 2 weeks after it was deposited.

        In re PRS Products, Inc., 574 F2d 414, 418 (8th Cir. 1978) - Court gave back the debtor his money after the bank took the money the same day it was deposited.


        This should be an eye opener for anyone who reads these forums that just because someone has a high post count doesn't mean they know what they are taking about.

            I think that's why many have disclaimers in their signature line and recommend those asking questions take the word of their lawyer.

                I just got the renewal for my car insurance and it went up like 600 dollars a year >< ... apparently its because the rates in VA have gone up. I'm also trying to figure out how to add my spouse without a social security number....tricky tricky.

                  I would move out of VA. Try living in TN, TX or FL. For what you're paying in state income tax, you could save thousands by living in one of those other states. My cousin will get a $500/mo. raise by moving to Florida with the same salary. He's buying a 4,000 sq. ft. house in Orlando.

                  People should not live in states with state income taxes. It's just another way the gov't rips you off. I would not stand for it.

                  Worst comes to worst, live in Illinois. It's only 3% there.

                    LOL yes... cause its sooooo easy to just up and move to another state. Unfortunately I've lived here all my life and this is probably where I will stay. I would also probably make less money in another state.

                      Don't just up and move right away. Put your resume all over Dice, Monster and other web sites first and wait until somebody hires you for the same or more money. I've moved all over the place in the past 15-20 years. It's no big deal to move. Try South Florida. At least we don't have cold in the teens here. Lots of people move here from up north.

                        Well I'm glad its worked for you... I happen to like it here. And I hate the heat. And unfortunately its not that simple for me to just up and leave the state. But thanks for the advice.

                        I just moved to another country and then back again... I think I'm done moving for quite some time.

                          Unfortunately I tried that same attitude by wanting to keep my BMW becaused I "liked it" and look what trouble it got me into.

                          You have to be rich to live in places like that where they have high property taxes on homes and a state tax. Try living in a state with no income tax and something like $500-1200/yr. on property tax for the home. People need to stop this crazy lifestyle stuff. Look where it got all of us here. It's not a sustainable thing. I am becoming a downsizing MAD MAN now.

                            I live in TX and even on our meager < 1500 sq ft home, our property taxes are more like 2k. No state tax, but our sales tax is over 8%.

                              You must live in a nice hood to pay that. My property taxes were $1100 and I was pissed at that. I had a 1500 sq. ft. house as well.

                              Our sales tax is about 6%.

                              The grass is greener here, literally. It's finding the $80,000+ dollar jobs that pay the green backs that are hard to find. We need to get all of the corporations to move here instead of staying up in cold areas with high taxes. It's like all of those people are masochists who love to suffer. I'd rather live in a state where I get to keep more of my money instead of giving it all away to the local governments.

                                I've lived here my whole life... and don't really have a problem with my lifestyle... the reason I had to file was moving overseas and getting laid off for 6 months. This is getting to be a bit of a defensive line of posting...so, I'm gonna leave it at that. I made a comment about my car insurance going up... not issues with living in my state.
