Well, wife and I went to talk to my lawyer on wednesday. He wants us to wait till Sept 1st to file. My income tax return in Feb. carries us over the median income. Ahh, the waiting and phone calls are driving me nuts!

Joined that club, brother. Best bet is to tell them each, you are filing for bk and to contact your lawyer and not to call your home or work again. Follow up with a letter and give your lawyers name and phone number. This worked for us very well and stopped a lot of calls even though we did not file till much later. 'Hub

Hey BC,

Did you take a means test? I met with an attorney yesterday as well. Although we almost double the median for California, she said we are 7 eligible. We have to look at our monthly expenses as comapred to our income. I don't understand how your tax return, would affect you that much, unless it was huge. Good luck with yours. Why September 1st. Is there a reason for the delay.

We are in the same sinking ship LOL! We, also, are having to wait until Sept. to file so we can use Mar-Aug Gross Income.

We met & retained our Attorney last Sept. I'm still working on filling out all the paperwork he gave us. I'll get started on a page, start looking for the info I need, get frustrated and quit. Hubby keeps telling me you don't have much time to get it all filled out.

He said we could file now, but if we are not on the verge of being sued, repo'd, or garnishment then it is best to wait until under the median income. Tax return was sizable ($3600. I know it is not good to let the government hold on to your money like that, but most of my income is quarterly commission and it is sometimes hard to just how much to take out so we don't owe or get a huge refund at the end of the year.). We stopped paying creditors 2-3 months ago. Phone calls are heavy but garnishments are a long way off and we are current on all secured loans. So it is not a problem to wait till sept (other than the annoying phone calls). I have actual not retained this lawyer so giving out his name and number is not an option right now. What would it do to tell them I am filing BK, but have not retained a lawyer? Would that hold them off for a week or so. Any break would help.

One good thing that came out of my meeting was in our district the trustee doesn't make you fill in all your household items for assest. Only larger items cars, boats, 4-wheelers, etc. My lawyer says he will just put down $1500 in household items and he has never been question. I dreaded listing all the items I own.

Join the club folks. We wanted to file in Oct of 2008 but my wife's old job that she lost due to medical reasons and our retirement income put us into a Chapter 13.
After reviewing the rules of that and realizing that it was a hard way to go we opted to wait until March of 2009 to file the chapter 7 just having the retirement income then.
It was a very long wait needless to say and very stressful but it can be done.

Now I'm clueless on the laws, but I since your got your 7 closed. Can you refile so soon in September??? Hope that's true for ya'll.

I'm kinna getting worried as we have received only 2 phone calls in the past 3 weeks. We quit paying all but one in late last Sept. Nothing much in the mailbox either. A Few collection agency's form letters but nothing demanding. Did get an offer on one of the credit cards - no thanks...preferential payment LOL!

What I'm worried about is Dh was in the hospital in April & didn't receive 3 weekly paychecks. I'm wondering if the Trustee will ask for Sept. weekly checks? Remember small town Attorney and he only files the last business of each month, so it will be 9/30/09.

Just got my last utility bill via email today due in Aug. So I can fill out the utilities on the budget sheet. We've got so many medical bills that need paying and not much money to pay them. Dh's hospital bill alone we owe $1,695.12. Even if we didn't include it in the BK, it would be so hard to get that paid off before it went to a collection agency. That amount is after insurance paid. I don't know how people who don't have insurance make it if they have an emergency as dh did.

We will have to keep each other updated on how our 3 cases are going k?

I am sure there is a copy of the ceast & desist paper somewhere on the internet ...I would copy it out and send it to all the creditors.... That should stop some of them for a while.... Well, again they are desperate so who knows !!!
