    leaving child support off papers

    I would like to know if anyone has left the child support they pay off there filing paperwork? We do pay child support to my husbands ex in another state and we are not behind we did leave it off because we do not want her notified lawyer said worse case we will have to add her at the 341. I would like to know if anyone elsse has done this? If so what happened?
    I know it would be easy to just put her on but she is the ex that no one wants to have believe me (thats why were in another state!)

    The problem could come if the trustee asks, it is always best to list it. Since child support isn't dischargeable there is not much that would happen if she knew, assuming the kids know she probably knows as well or will in time.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      The kids dont know and i know its not dischargeable. We pay her directly anyway. Like i said we are not behind just dont want her knowing our business. lawyer had said If he asks directly do you have a support order than we have to say yes but if he says are you behind than we arent so our answer would be no. He did say at that point we would just add her to the papers. we are not trying to lie or get out of anything just dont want her to know any of our business. Just wondering if anyone else might of done the same? thanks everyone

        if your lawyer told you what to do and it meets your needs, I wouldn't listen to anyone else's advice.

          sometimes you can leave non-dischargeable loans out for reasons like this, if they make no real difference to the petition.

            I would only be concerned that the Trustee would wonder where that part of your income goes and why it's not available to pay creditors.

            If you need the expense to pass the means test, but don't list the party on your schedules, I don't know how that's going to go over with the Trustee.
